  • “Condition Category” refers to container condition classifications described on our Conditions page and product listings.
  • “Dispatch” means the point at which a carrier has been scheduled and the container is released for delivery.

3. Eligibility and Accuracy of Information

To place an order, you confirm that you:

  • are at least 18 years old, and
  • have authority to purchase on behalf of yourself or your organization, and
  • will provide accurate billing, delivery, and contact information.

We may decline or pause an order where information is incomplete, inconsistent, or where delivery appears unsafe or not feasible.

4. Product Information and Condition Expectations

Shipping containers are industrial assets. Product listings describe container types, features, and condition categories as accurately as possible.

You acknowledge that:

  • cosmetic wear may be present depending on the stated condition category, and
  • used containers may show dents, surface rust, paint wear, and markings consistent with prior service, and
  • variation in appearance is normal for industrial equipment.

5. Pricing, Quotes, and Availability

Pricing

Prices displayed on the website represent the product price unless otherwise stated. Prices may change based on:

  • inventory availability
  • regional logistics
  • supplier and market conditions

Shipping and Additional Charges

Unless explicitly stated, product prices exclude delivery. Shipping costs depend on location and logistics requirements and are confirmed prior to dispatch.

Availability

Product availability can change quickly. An order is only secured after confirmation and payment (see Section 6).

6. Orders, Invoicing, and Payment

Order Confirmation

An order is confirmed when:

  • you receive written confirmation (invoice or order confirmation), and
  • payment is received and verified.

Payment Requirement

Full payment is required before dispatch scheduling is finalized, unless a written deposit arrangement has been approved for that specific order.

7. Shipping, Delivery, and Site Requirements

Delivery Area

We deliver across the United States (subject to access and carrier availability) and internationally by arrangement.

Delivery Timelines

Delivery timelines are estimates and depend on scheduling, location, and carrier availability. Freight deliveries are not guaranteed to occur on a specific date unless confirmed in writing.

Site Access (Customer Responsibility)

You are responsible for ensuring the delivery site is accessible and suitable for freight delivery, including:

  • clear access for large vehicles
  • adequate turning/placement space
  • level and stable ground
  • no overhead obstructions where applicable

If delivery fails due to site access issues, rescheduling fees, redelivery costs, or carrier charges may apply.

8. Inspection and Acceptance

7-Day Inspection Window

You must inspect the container promptly after delivery. Concerns related to:

  • incorrect unit delivered,
  • wrong size/type,
  • wrong condition category,
  • major functional issues inconsistent with the listing, or
  • apparent transport damage

should be reported within 7 calendar days of delivery.

This inspection window supports fair resolution and aligns with freight realities.

9. Returns, Refunds, and Cancellations

Returns and Refunds

Returns and refunds are handled strictly according to our Return & Refund Policy, including:

  • a 7-day inspection and acceptance period, and
  • up to 30 days for conditional return requests (subject to eligibility conditions).

Cosmetic wear consistent with the stated condition category is not considered a defect.

Cancellations

Cancellations may be possible before dispatch scheduling is finalized. If planning, allocation, or carrier scheduling has begun, cancellation may involve administrative or carrier costs. Details are outlined in the Return & Refund Policy.

10. Sales Tax and Exemptions

Sales tax may apply based on delivery location and applicable rules. If you are tax-exempt, required documentation must be provided before payment for review and approval.

11. Title, Risk of Loss, and Use

Unless otherwise required by law:

  • Title and risk of loss generally transfer to the customer upon delivery and acceptance at the delivery location.
  • Customers are responsible for safe and compliant use of containers after delivery, including any modifications, permitting, zoning, or site compliance.

12. No Misleading Guarantees

We do not present shipping containers as factory-new unless stated under recognized industry definitions (for example, “New (One-Trip)”).

Any statements on the website should be understood in the context of industrial container standards and the applicable condition category.

13. Limitation of Liability

To the fullest extent permitted by applicable law, HACON CONTAINERS is not liable for:

  • indirect, incidental, or consequential damages
  • losses caused by delays outside our control (carrier disruptions, weather, site inaccessibility, force majeure)
  • damages arising from misuse, modification, or improper placement after delivery

Where liability cannot be excluded, our total liability is limited to the amount paid for the relevant product(s), unless otherwise required by law.

14. Intellectual Property

15. Changes to These Terms

For orders delivered within the United States, these Terms are intended to be interpreted consistently with applicable U.S. consumer and commercial rules, and practical dispute resolution will be pursued in good faith.

For orders outside the U.S., applicable local rules may apply depending on destination and transaction structure.
